Disability Insurance Disputes / ERISA
Florida Lawyers: Disability Insurance, ERISA Disputes
If you have become disabled by illness or injury and are no longer able to work, you expect your disability insurance company to provide the benefits described in your insurance policy. Sadly, many disabled people are denied coverage for claims.
Insurance companies will sometimes display a shocking lack of compassion and basic fairness by denying valid disability claims for coverage under long-term and short-term disability policies. If you are involved in a dispute over a disability claim, please contact an attorney at The Nation Law Firm for a free initial consultation and case evaluation.
Our Orlando Attorneys have handled claims against some of the largest insurance companies in the country and won results for our disabled clients. We have handled cases involving difficult-to-prove diagnoses such as fibromyalgia, chronic fatigue syndrome, immune deficiency, and headaches, as well as various forms of cancer, back injuries, chemical sensitivity, drug and alcohol addition, and mental and nervous conditions, just to name a few.
We have successfully resolved all types of disability insurance disputes, including those involving the Employee Retirement Income Security Act (ERISA). In fact, a large part of our disability practice is devoted exclusively to ERISA claims. If you have looked for very long, we know that it is hard to find an attorney to take an ERISA claim. We do.
Unless you work for the government or a religiously affiliated institution, your employer-sponsored disability insurance policy is likely to be governed by ERISA. Disputing a denial can be difficult, confusing, and very challenging.
In most cases, policyholders are allowed only a single appeal of an ERISA claim denial. If the appeal is denied, you can file a lawsuit in federal court. The case will not be heard by a jury, you will not be allowed to submit any new evidence, and no witnesses may testify on your behalf. The entire case is typically decided on the administrative record accumulated by the insurance company alone. Unless you are represented by a skilled attorney who knows understands the law and knows how to protect your rights, you will be at an extreme disadvantage.
Private Disability Insurance Appeals
We also represent doctors, lawyers, and other professionals whose disability claims are denied by their private insurance carriers. In some instances insurance companies deny or delay claim payments systematically-without a good reason-just hoping the policyholder will give up the fight and go away. In these so-called bad faith cases, our attorneys can not only force the insurance company to pay the benefits called for in your policy, but can also seek punitive damages and often all legal fees and costs.
